BeneFLEX is in the process of updating all Business Associate Agreements to comply with the new HIPAA laws.  We have been preparing for this time by performing a HIPAA Security Risk Analysis. As a result, we recertified our staff, and updated our HIPAA policies and procedures, all to be in compliance with the new HIPAA regulations. This process includes the HIPAA mandated changes and update of our Business Associate Agreements (BAA).

For existing clients with BAAs, this new BAA replaces your previous BAA with BeneFLEX. As outlined by the guidance, there is the ability to take an extra year (until 9/23/14) to bring certain existing BAAs into compliance with the new rules. This extended deadline is available for BAAs that (1) existed on 1/25/13, (2) complied with the HIPAA privacy and security rules and (3) were not renewed or amended between 3/26/13 and 9/23/13.

You are receiving this e-mail as we are now in the process of replacing all the BAAs for existing clients. Our goal is to have everyone sign the updated agreements by October 15th before the busy season.

As a reminder:
Business Associate Contracts. A covered entity’s contract or other written arrangement with its business associate contains the elements specified at 45 CFR 164.504(e). For example, the contract must: Describe the permitted and required uses of protected health information by the business associate; Provide that the business associate will not use or further disclose the protected health information other than as permitted or required by the contract or as required by law; and Requires the business associate to use appropriate safeguards to prevent a use or disclosure of the protected health information other than as provided for by the contract.

ACTION STEPS:

  1. Attached is a new BAA agreement for your review and signature.
  2. Open the document and download it to your computer. 
  3. On the first page type in your legal business name.
  4. On the last page – Please sign by typing in your name, make copies for yourself.
  5. E-mail back the entire document when completed, by October 15th if possible.
  6. Your typed signature and submission of the e-mailed document constitutes a legal and binding signature to the new 2013 BAA with BeneFLEX HR Resources.
